1.2 Scope of Application

These Terms of Service govern the use of the mobile application "Einbürgerungstest" between the provider and users.

By downloading, installing, or first using the app, you agree to these Terms of Service. Deviating conditions by the user are not recognized unless we expressly agree to their validity in writing.

2. Service Description

2.1 Purpose of the App

The "Einbürgerungstest" app is a learning aid for preparing for the official German citizenship test. It provides:

Access to official exam questions
Various practice modes (test mode, state-specific, practice weaknesses)
Progress tracking and statistics
Offline use without internet connection
Bookmark function for important questions

2.2 No Success Guarantee

Important Notice: The app serves exclusively as a learning aid. We do not guarantee passing the official citizenship test. Success depends on individual preparation and other factors.

2.3 Free Use

Basic use of the app is free of charge. Additional premium features may be paid (if available).

2.4 Advertising

The app is funded through advertising. We use Google AdMob to display advertisements:

Ad Formats: Banner ads and rewarded ads
Personalized Advertising: Only with your explicit consent
Non-personalized Advertising: General ads without tracking if you decline personalized advertising

Your Control Over Advertising:

3. Usage Rights and Restrictions

3.1 Granted Rights

We grant you a non-exclusive, non-transferable, revocable right to use the app privately on your own devices.

3.2 Usage Restrictions

You agree not to use the app for the following purposes:

Reverse engineering, decompilation, or disassembly
Circumventing security measures or copy protection
Distribution of malware or harmful code
Violation of laws or third-party rights
Automated data extraction or harvesting

3.3 Responsibility for Device Security

You are responsible for the security of your device. Use current operating systems and security updates.

4. Availability and Technical Requirements

4.1 Availability

We strive for high availability of the app but cannot guarantee 100% availability. Maintenance work and technical disruptions may lead to temporary restrictions.

4.2 Technical Requirements

Minimum requirements:

iOS: Version 12.0 or higher
Android: Version 6.0 (API Level 23) or higher
Sufficient storage space (approx. 100 MB)
Internet connection for updates and optional features

4.3 Updates

We may provide app updates at any time. These may include new features, bug fixes, or security improvements. Important updates should be installed promptly.

All content of the app, including but not limited to:

Software code and program architecture
User interface and design

are protected by our copyright or that of our licensors.

5.2 Exam Questions

The exam questions come from publicly available sources (Federal Office for Migration and Refugees). These are not subject to our copyright.

5.3 Trademark Rights

The name "Einbürgerungstest" and associated logos are our trademarks or trademarks of our licensors.

6. Limitation of Liability

6.1 Content Liability

We assume no warranty for:

The completeness, accuracy, or timeliness of exam questions
Passing the official citizenship test
Changes to the official examination regulations

6.2 Technical Liability

We are not liable for damages caused by:

Technical disruptions or failures
Loss of learning data due to improper use
Incompatibility with certain devices
Internet connection problems

6.3 Limitation of Liability

Our liability is limited to intent and gross negligence. Liability for indirect damages, lost profits, or consequential damages is excluded to the extent legally permissible.

                Important: These liability limitations do not apply to damages from injury to life, body, or health, or in case of violation of essential contractual obligations.
            

7. Data Protection

The protection of your personal data is important to us. Details on data processing can be found in our Privacy Policy.

7.1 Local Data Storage

Your learning data is primarily stored locally on your device and is not transmitted.

7.2 Optional Data Transmission

Analytics and crash reporting only occur with your explicit consent and can be deactivated at any time in the settings.

7.3 Advertising and Data Processing

For displaying advertisements, we work with Google AdMob:

Personalized Advertising: Requires your consent under GDPR and is obtained through a consent dialog (Consent Management)

8. Termination of Use

Upon termination of use:

All usage rights expire
Local data can be deleted by uninstalling
Liability disclaimers and damage claims remain in effect

9. Changes to Terms of Service

9.1 Right to Change

We reserve the right to change these Terms of Service to adapt them to changed legal situations, technical developments, or new features.

9.2 Notification

You will be informed of significant changes through:

In-app notification
Update of the date at the top of the Terms of Service
Email notification (if available)

9.3 Right to Object

You may object to changes within 30 days of notification. In case of objection, the usage authorization ends.

10. Final Provisions

10.1 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.

10.2 Jurisdiction

The place of jurisdiction for all disputes is the provider's place of business, provided you are a merchant, legal entity under public law, or special fund under public law.

10.3 Severability Clause

Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions remains unaffected.

10.4 Consumer Arbitration

We do not participate in dispute resolution proceedings before a consumer arbitration body. In case of disputes, you can contact local consumer centers.
